Today, a century and a half after the abolition of slavery across most of the Americas, the idea of monetary reparations for former slaves and their descendants continues to be a controversial one. Lost among these debates, however, is the fact that such payments were widespread in the nineteenth century—except the “victims” were not slaves, but the slaveholders deprived of their labor. This landmark comparative study analyzes the debates over compensation within France and Great Britain. It lays out in unprecedented detail the philosophical, legal-political, and economic factors at play, establishing a powerful new model for understanding the aftermath of slavery in the Americas.

A new edition of F. A. Hayek’s three-part opus Law, Legislation, and Liberty, collated in a single volume In this critical entry in the University of Chicago’s Collected Works of F. A. Hayek series, political philosopher Jeremy Shearmur collates Hayek’s three-part study of law and liberty and places Hayek’s writings in careful historical context. Incisive and unrestrained, Law, Legislation, and Liberty is Hayek at his late-life best, making it essential reading for understanding the philosopher’s politics and worldview. These three volumes constitute a scaling up of the framework offered in Hayek’s famed The Road to Serfdom. Volume 1, Rules and Order, espouses the virtues of classical liberalism; Volume 2, The Mirage of Social Justice, examines the societal forces that undermine liberalism and, with it, liberalism’s capacity to induce “spontaneous order”; and Volume 3, The Political Order of a Free People, proposes alternatives and interventions against emerging anti-liberal movements, including a rule of law that resides in stasis with personal freedom. Shearmur’s treatment of this challenging work—including an immersive new introduction, a conversion of Hayek’s copious endnotes to footnotes, corrections to Hayek’s references and quotations, and the provision of translations to material that Hayek cited only in languages other than English—lends it new importance and accessibility. Rendered anew for the next generations of scholars, this revision of Hayek’s Law, Legislation, and Liberty is sure to become the standard.

Spanning over 2 centuries, James Gregory's Mercy and British Culture, 1760 -1960 provides a wide-reaching yet detailed overview of the concept of mercy in British cultural history. While there are many histories of justice and punishment, mercy has been a neglected element despite recognition as an important feature of the 18th-century criminal code. Mercy and British Culture, 1760-1960 looks first at mercy's religious and philosophical aspects, its cultural representations and its embodiment. It then looks at large-scale mobilisation of mercy discourses in Ireland, during the French Revolution, in the British empire, and in warfare from the American war of independence to the First World War. This study concludes by examining mercy's place in a twentieth century shaped by total war, atomic bomb, and decolonisation.

The Battles of Saratoga are cited as the turning point in the Revolutionary War. Beginning when the armies prepared to face off in June 1777 through the surrender of the British Army in October, the battles of the Northern Campaign were significant to the outcome of the War and the fight for independence. As a result of the Saratoga battles, the patriots gained confidence, the French entered the war, and the British plan to win the war quickly was put to an end. Master historical painter Don Troiani and historian Eric Schnitzer combine their talents in this new book on Saratoga, the Revolutionary War campaign. This magnificently illustrated history features many new artworks, previously unpublished eyewitness accounts, photographs of important artifacts, and a solid, detailed historical narrative including background on the campaigns leading up to Saratoga.

"Yankee Sailors in British Gaols offers the first comprehensive account of American servicemen detained within the confines of Mill and Forton prisons, the principal land-based detention centers in Britain during the American Revolution. Forton and Mill during the course of the War of Independence held approximately 3,000 American prisoners, almost all of them naval personnel. In a few cases, these American prisoners were incarcerated for more than four years, a longer recorded period of incarceration in overseas prisons than in any United States war prior to Vietnam. Professor Cohen's examination of wide-ranging and widely scattered primary and secondary sources provides an extraordinarily detailed picture of life within the closed society of each prison, as well as insight into the various ways in which Britons and Americans outside the prisons provided legal and extralegal help to the rebel detainees."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. The bestselling author of Black Flags, Blue Waters reclaims the daring freelance sailors who proved essential to the winning of the Revolutionary War. The heroic story of the founding of the U.S. Navy during the Revolution has been told many times, yet largely missing from maritime histories of America’s first war is the ragtag fleet of private vessels that truly revealed the new nation’s character—above all, its ambition and entrepreneurial ethos. In Rebels at Sea, best-selling historian Eric Jay Dolin corrects that significant omission, and contends that privateers, as they were called, were in fact critical to the American victory. Privateers were privately owned vessels, mostly refitted merchant ships, that were granted permission by the new government to seize British merchantmen and men of war. As Dolin stirringly demonstrates, at a time when the young Continental Navy numbered no more than about sixty vessels all told, privateers rushed to fill the gaps. Nearly 2,000 set sail over the course of the war, with tens of thousands of Americans serving on them and capturing some 1,800 British ships. Privateers came in all shapes and sizes, from twenty-five foot long whaleboats to full-rigged ships more than 100 feet long. Bristling with cannons, swivel guns, muskets, and pikes, they tormented their foes on the broad Atlantic and in bays and harbors on both sides of the ocean. The men who owned the ships, as well as their captains and crew, would divide the profits of a successful cruise—and suffer all the more if their ship was captured or sunk, with privateersmen facing hellish conditions on British prison hulks, where they were treated not as enemy combatants but as pirates. Some Americans viewed them similarly, as cynical opportunists whose only aim was loot. Yet Dolin shows that privateersmen were as patriotic as their fellow Americans, and moreover that they greatly contributed to the war’s success: diverting critical British resources to protecting their shipping, playing a key role in bringing France into the war on the side of the United States, providing much-needed supplies at home, and bolstering the new nation’s confidence that it might actually defeat the most powerful military force in the world. Creating an entirely new pantheon of Revolutionary heroes, Dolin reclaims such forgotten privateersmen as Captain Jonathan Haraden and Offin Boardman, putting their exploits, and sacrifices, at the very center of the conflict. Abounding in tales of daring maneuvers and deadly encounters, Rebels at Sea presents this nation’s first war as we have rarely seen it before.

In the Cause of Humanity is a major new history of the emergence of the theory and practice of humanitarian intervention during the nineteenth century when the question of whether, when and how the international community should react to violations of humanitarian norms and humanitarian crises first emerged as a key topic of controversy and debate. Fabian Klose investigates the emergence of legal debates on the protection of humanitarian norms by violent means, revealing how military intervention under the banner of humanitarianism became closely intertwined with imperial and colonial projects. Through case studies including the international fight against the slave trade, the military interventions under the banner of humanitarian aid for Christian minorities in the Ottoman Empire, and the intervention of the United States in the Cuban War of Independence, he shows how the idea of humanitarian intervention established itself as a recognized instrument in international politics and international law.
